Created AJTKD according to art. 5 of the federal constitution


Art. 5th - All are same before the law, without distinction of any nature, being guaranteed to the Brazilians and the resident foreigners in the country the inviolability of the right to the life, to the freedom, to the equality, to the safety and the property, in the following terms:

I - men and women are same in rights and obligations, in the terms of this Constitution;

II - nobody will be forced to do or to leave of doing some except thing because of law;

III - nobody will be submitted to torture nor to treatment inhuman or degrading;

IV - it is free the manifestation of the thought, being banned the anonymity;

V - it is insured the answer right, proportional to the offence, besides the compensation for damage material, moral or to the image;

VI - it is inviolable the freedom of conscience and of faith, being insured the free exercise of the religious and guaranteed cults, in the form of the law, the protection to the cult places and their liturgies;

VII - it is insured, in the terms of the law, the installment of religious attendance in the civil and military entities of collective internment;

VIII - nobody will be deprived of rights because of religious faith or of conviction philosophical or political, except for if invoking to exempt of legal obligation the all imposed and to refuse to accomplish alternative installment, fastened in law;

IX - it is free the expression of the activity intellectual, artistic, scientific and of communication, independently of censorship or license;

X - Is inviolable the intimacy, the private life, the honor and the people's image, insured the right the compensation for the damage material or moral due to its violation;

XI - the house is the individual's inviolable asylum, nobody could penetrate without the resident's consent, except for in case of instant crime or disaster, or to render help, or, during the day, for judicial determination;

XII - it is inviolable the secrecy of the correspondence and of the telegraphic communications, of data and of the phone communications, except for, in the last case, for judicial order, in the hypotheses and in the form that the law to establish for ends of criminal investigation or penal procedural instruction;

XIII - it is free the exercise of any work, occupation or profession, assisted the professional qualifications to establish;

XIV - it is insured to all the access to the information and protected the secrecy of the source, when necessary to the professional exercise;

XV - it is free the locomotion in the national territory in time of peace, being able to anybody, in the terms of the law, in him to enter, to stay or of him to leave with their goods;

XVI - all can meet pacifically, without weapons, in places open to the public, independently of authorization, since they don't frustrate another meeting previously summoned to the same place, being just demanded previous warning to the competent authority;

XVII - it is full the association freedom for ends lawful, prohibited the one of paramilitary character;

XVIII - the creation of associations and, in the form of the law, the one of cooperatives authorization independem, being banned the state interference in his/her operation;

XIX - the associations will only be able to be dissolved (compulsory) or to have their suspended activities for judicial decision, being demanded, in the first case, the traffic in having judged;

XX - nobody can be compelled to associate or to stay associated;

XXI - the entities associative, when expressly authorized, have legitimacy to represent yours adopted judicial or extra-juridically;
